This Catering Service Agreement is entered into between (the “Caterer”) and (the “Client”) for the event described below. The menu and services referenced are those agreed in writing between the parties.
Guest Count
The estimated guest count above is set at signing. The Client will provide a final guaranteed guest count no later than the date shown. Billing is based on the guaranteed count or actual attendance, whichever is greater; the guaranteed count may not be reduced after the deadline.
Cancellation Policy
If the Client cancels 30 or more days before the event, the deposit is forfeited and no further balance is owed. If the Client cancels 14 to 29 days before the event, the deposit is forfeited and 50% of the remaining balance is due. If the Client cancels fewer than 14 days before the event, the full contract amount is due and no refund is issued.
Dietary Restrictions & Allergies
The Client is responsible for reporting all guest allergies and dietary restrictions to the Caterer no later than the final guaranteed count deadline. The Caterer is not responsible for reactions arising from allergies or dietary needs that were not reported by that deadline.
Staffing & Overtime
Service staff are provided for the service hours stated above. If the Client requests service beyond those hours, additional time is billed at the overtime hourly rate shown, in half-hour increments; the Client's request for extended service constitutes authorization of those charges.
Force Majeure
Neither party is liable for failure to perform due to causes beyond its reasonable control, including severe weather, natural disaster, government order, or utility failure at the venue. If such an event prevents performance, the parties will make good-faith efforts to reschedule; if rescheduling is not possible, amounts already paid for services not rendered will be addressed in good faith between the parties.
